General Terms and Conditions

1 Scope of application
These General Terms and Conditions (hereinafter referred to as "GTC") govern the contractual relationship between the customer (visitor) and Feldschlösschen Getränke AG (hereinafter referred to as "FSG") for services in connection with visitor tours for which FSG itself acts as provider/organiser.

2 Conclusion of contract
2.1 Booking
The various visitor tours are listed on the websites www.feldschloesschen.ch and www.brauwelt.ch or in other means of communication of FSG. The customer's booking (in writing, by e-mail, by telephone, online by sending the completed input mask) constitutes a binding request to FSG for the selected tour. The customer is obliged to provide all information required during the order process completely and correctly.

2.2 Order confirmation
The receipt of the booking will subsequently be confirmed to the customer (by telephone, in writing, by sending an e-mail or by a system message) and is not yet considered as a definite commitment by FSG.

2.3 Acceptance by FSG
The contract for the visitor tour is only concluded upon written confirmation by FSG to the customer.

2.4 Non-binding enquiry
If the customer (by telephone, in writing, by e-mail or by sending the completed input mask) has only sent a non-binding enquiry, the written reply by FSG constitutes a binding offer which requires written acceptance by the customer.

3 Fulfilment of the contract and cancellation
FSG undertakes to fulfil the contractually agreed services correctly. Late participants cannot be waited for due to organisational reasons.
If the booked visitor tour is cancelled after conclusion of the contract for reasons for which FSG itself is responsible, payments already made will be refunded to the customer. Any outstanding claims of FSG against the customer arising from the cancelled booking shall be cancelled. Further claims of the customer against FSG are excluded.
For the cancellation by the customer and its financial consequences, the cancellation conditions listed below under point 6 are authoritative.

4 Liability of FSG
The client is responsible for the safekeeping of valuables during the tours.
The instructions of the tour guides must be followed.
FSG is only liable for intent and gross negligence. Liability for slight negligence and liability for auxiliary persons are excluded. FSG is in no case liable for the customer's own fault and for third party fault as well as for further direct or indirect consequential damages. FSG further accepts no liability for technical problems that may arise in connection with the use of the websites www.feldschloesschen and www.brauwelt.ch, does not guarantee uninterrupted and continuous availability of its websites and accepts no responsibility for technical problems and/or loss of data or other technical defects in communication with the websites.

5 admission fees and terms of payment
5.1 Entrance fees
A visitor tour for up to 30 persons is conducted by a tour guide. For larger groups, several tour guides will be used, depending on the number of participants. The current admission prices listed on the website of www.feldschlösschen.com apply. For groups of 15 or fewer participants, a flat rate is payable in accordance with a separate written agreement.
5.2 Group tours Payment is to be made before the tour in cash or by Twint, Maestro card, Postcard, Visa or Mastercard. All prices are in Swiss francs including VAT. Conversion into euros is at the exchange rate of the day.

5.3 Public tours

Tickets for public tours are generally non-refundable. If an event is cancelled by FSG due to a lack of a minimum number of participants or in the event of force majeure (including closure ordered by the authorities), the customer is entitled to a refund or exchange of the ticket.

5.4 Guarantee
FSG may at any time require a credit card as a guarantee of payment for a binding confirmation.

6 cancellation conditions
In case of cancellation of a group tour by the client, the following costs will be charged:
- Non-appearance of the group (no show): 100%.
- 0 to 2 working days before the start of the tour: 100%.
- 3 to 7 working days before the start of the tour: 50%.

7 reduction in number of visitors
The client may adjust the number of visitors confirmed in accordance with 2.3. or 2.4. up to 14 days before the date of the event at the latest without incurring any costs. From this point in time, the number of visitors is binding and forms the basis for invoicing.

8 delays / waiting times of guides
In the event of delays, the time of the guided tour shall be shortened accordingly. For group tours, the waiting time of the tour guides on site is a maximum of 30 minutes.

9 programme changes and cancellation of a guided tour by FSG
A guided tour may be changed due to unforeseeable circumstances. In this case, FSG will endeavour to find an equivalent replacement or another suitable solution. In the event of force majeure, official measures, accidents, technical defects, etc., FSG may cancel a guided tour and refund the amount already paid.

10 Catering
The customer must order catering directly from Schlossgarten Gastronomie AG together with the booking. The General Terms and Conditions of
Schlossgarten Gastronomie AG apply.

11 Applicable law and place of jurisdiction
These General Terms and Conditions and the contractual relationship between FSG and the customer shall be governed exclusively by Swiss law. The place of jurisdiction is CH-4310 Rheinfelden (unless there is a mandatory statutory place of jurisdiction).
